Hiring a Development Team in India from Australia: A Practical Guide for Australian Founders

If you run a startup or business in Australia and you are thinking about a development team in India, your questions are practical ones. How much of the day will we actually share? What does the Privacy Act say about personal data handled from overseas? Who owns the code, and how does GST work on the invoices? This guide answers those questions from the side of the table I sit on every week.

A good share of the founders I speak with are in Australia, from Sydney and Melbourne startups to established businesses in Brisbane and Perth that have outgrown spreadsheets. Most have already decided that a team in India could suit their budget and pace. What they want to know is how it works week to week, and what to set up on their side so nothing causes trouble later. If you are still deciding whether to build in India at all, start with our wider guide to outsourcing software development to India. This one is for Australian founders who are ready to hire.

The short version

Use your afternoon as the shared working window, plan for the Privacy Act and APP 8 before anyone touches real customer data, put IP assignment and code ownership in the contract, and let your accountant check how GST applies to the invoices. Get these four right and the distance is rarely the problem.

Your afternoon is our morning

India Standard Time stays the same all year. Australia has several time zones, and only some states use daylight saving, so the gap depends on where you are and the season. Here is what it looks like if the team in India starts at 9 am IST:

Where you areAhead of India by9 am in India is yourShared hours in your working day
Sydney, Melbourne, Canberra, Hobart (winter)4.5 hours1:30 pmAbout four, from 1:30 pm onwards
Sydney, Melbourne, Canberra, Hobart (daylight saving)5.5 hours2:30 pmAbout three, from 2:30 pm onwards
Brisbane (no daylight saving)4.5 hours1:30 pmAbout four all year
Adelaide4 hours in winter, 5 in daylight saving1 pm or 2 pmThree to four and a half
Perth2.5 hours11:30 amMost of the working day

In practice that means a short call in your early afternoon, quick questions answered the same day, and your morning free to review what was built the day before. Two habits keep this running smoothly:

  • One place for decisions: a shared board or a single channel, so nothing lives only in a call.
  • Holidays on both sides: Australian public holidays differ by state and rarely line up with Indian festivals such as Diwali. Put both in the project calendar at the start.

The Privacy Act and APP 8

This is the point many Australian founders have not thought about until a customer or investor asks. If your business is covered by the Privacy Act 1988, the Australian Privacy Principles apply to how you collect and handle personal information. APP 8 deals with disclosing personal information to someone overseas. In general you need to take reasonable steps so the overseas recipient handles it in line with the APPs, and you can be held accountable if it does not. The OAIC's APP 8 guidelines set out the detail. For most product builds it comes down to this:

  1. Host in Australia where it matters: AWS, Azure and Google Cloud all have Australian regions, so production data can stay at home even when engineers in India maintain the system.
  2. Keep real data out of development: the team builds and tests with made-up or anonymised data, so most of the work involves no personal information at all.
  3. Put the remaining access under contract: if engineers need to reach live data, for example to fix a production issue, the contract should bind the vendor to handle it in line with the APPs, limit who can see it and log that access.
  4. Plan for data breaches: the Notifiable Data Breaches scheme may require you to notify affected people and the OAIC. Your vendor should be required to tell you quickly if something goes wrong.

Your development partner should raise this in the first call and design for it: collection notices, consent, access and correction requests, retention rules and audit logs. Legal sign-off stays with your company and your adviser, including whether the Act applies to your business at all.

Contracts, IP and code ownership

Investors and buyers will check that your company owns its software. Make sure the contract covers:

  • IP assignment: all code, designs and documents created for you are assigned to your Australian company, with a clear point at which ownership passes, such as on payment of each milestone.
  • Where the code lives: the repository, cloud hosting, app store developer accounts and domain should be in your company's name, not the vendor's. This is how we work at Creuto from day one.
  • Governing law and disputes: many Australian clients ask for the law of their own state. Agree it in writing and have your lawyer review this part.
  • Scope and change control: a written scope, how changes are priced and approved, and what happens if you pause or stop.
  • Warranty and support: how long bugs are fixed after launch at no extra cost. Ours is 60 days.

Our software development contract checklist goes through each clause in more detail.

Invoices, currency and GST

Paying an Indian company from Australia is simple once it is set up. Sort these out before the first invoice:

  • Currency: agree whether invoices are in Australian dollars or another currency, so exchange rate movements do not surprise either side.
  • Payment method: international bank transfer is the usual route. Ask the vendor which method reaches its bank fastest.
  • GST: an overseas supplier generally does not charge Australian GST to a GST-registered business buying services for that business. In some situations the reverse charge applies and you account for the GST in your own activity statement. Let your accountant confirm what applies to you.
  • Milestone schedule: tie each payment to working software you have seen in a demo, not to time passing.

What the first month should look like

The first month tells you whether the partnership will work. Here is what I would expect to see, and what we aim for at Creuto:

  1. Week 1: a short discovery, then a written product requirements document with scope, priorities and what is left out on purpose.
  2. Week 1 to 2: screens designed and agreed, with the repository and cloud accounts set up in your company's name and an Australian hosting region chosen if you need one.
  3. Week 2 to 4: building in short cycles, with demos in your afternoon so you see real progress, not slide updates.
  4. Around week 4: a first working version you can click through and put in front of early users.

If speed to a first release matters most, our MVP development service is built around this rhythm.

Planning the budget

Cost depends on scope, platforms and integrations far more than on location. For a realistic picture before you speak to anyone, try our app timeline calculator or look at what drives project costs for products like marketplaces, booking apps and ERP systems. Then ask every partner you shortlist for a written, itemised proposal so you can compare like with like.

Red flags for Australian founders

  • The vendor wants the code, cloud or app store accounts in its own name.
  • No one asks about the Privacy Act, hosting region or who can see live data before quoting.
  • Engineers ask for a copy of your live customer database to "test with".
  • No one senior is available in your afternoon once the contract is signed.
  • Progress is reported in hours and percentages, not working demos.
  • There is no written warranty period after launch.

Frequently asked questions

How many working hours does an Australian company share with a team in India?

Sydney and Melbourne are 4.5 hours ahead of India in the Australian winter and 5.5 hours ahead during daylight saving. India does not change its clocks. Your afternoon overlaps with the Indian team's morning, which usually gives three to four shared hours a day. Perth is only 2.5 hours ahead, so West Australian teams share most of the working day.

Can a team in India handle personal information of Australian users?

Yes, with the right steps. Under Australian Privacy Principle 8, before you disclose personal information to an overseas recipient you generally need to take reasonable steps so that it is handled in line with the APPs, and you can remain accountable for what that recipient does. Hosting in Australia and keeping real data out of development reduces the exposure. Your legal adviser confirms the final position.

Who owns the code when an Australian company hires a team in India?

Ownership is set by your contract, so it must assign the intellectual property to your company. At Creuto the code lives in your own accounts from day one and ownership passes to you as each milestone is paid.

Do Australian businesses pay GST on invoices from an Indian development company?

An overseas supplier generally does not charge Australian GST to a GST-registered business that buys services for its business. In some cases the reverse charge applies and you account for the GST yourself. Your accountant should confirm how this applies to you.

How quickly can we see working software?

At Creuto the first working version typically takes about 4 weeks, starting from a clear product requirements document. Larger products are then built in milestones with a demo at each one.
