Hiring a Development Team in India from the USA: A Practical Guide for US Founders
If you run a US startup or company and you are thinking about building your product with a team in India, the questions are practical ones. When will we talk? Who owns the code? How do I pay them, and what paperwork does my accountant need? What about HIPAA or CCPA? This guide answers those questions from the side of the table I sit on every week.
In this guide 9 sections
A good share of the founders I speak with are in the US. Most of them have already decided that a team in India makes sense for their budget and speed. What they want to know is how it works day to day, and what they need to set up on their side so nothing goes wrong later. If you are still deciding whether to build in India at all, start with our wider guide to outsourcing software development to India. This one is for US founders who are ready to hire.
The short version
Agree a fixed daily call window, put IP assignment and code ownership in the contract, collect the right tax form before the first invoice, and decide which US rules apply to your product before design starts. Do these four things and the distance stops being a problem.
Time zone overlap by US region
India Standard Time does not change with the seasons, but US time does. That means your overlap with India shifts by an hour twice a year, when US daylight saving starts in March and ends in November. Here is what a typical Indian team's working evening, roughly 6 pm to 10 pm IST, looks like from each US region.
| US region | Hours behind India | India 6 pm to 10 pm is | What usually works |
|---|---|---|---|
| Eastern (New York) | 9.5 in summer, 10.5 in winter | 8:30 am to 12:30 pm in summer, 7:30 to 11:30 am in winter | Daily call at the start of your day |
| Central (Chicago) | 10.5 in summer, 11.5 in winter | 7:30 to 11:30 am in summer, 6:30 to 10:30 am in winter | Morning call, a little earlier than you may like |
| Mountain (Denver) | 11.5 in summer, 12.5 in winter | 6:30 to 10:30 am in summer, 5:30 to 9:30 am in winter | Early morning or a fixed evening slot |
| Pacific (San Francisco) | 12.5 in summer, 13.5 in winter | 5:30 to 9:30 am in summer, 4:30 to 8:30 am in winter | A fixed late-evening slot for you, which is India's morning |
The overlap is only part of it. The bigger advantage is the handover: you review a build and leave feedback in your afternoon, the team works on it during your night, and the change is waiting for you the next morning. That only works if feedback is written down clearly, so agree one place for it, such as a shared board or a single channel, and keep decisions there rather than in scattered calls.
Contracts, IP and code ownership
US founders often worry most about this, and rightly so. Your investors will ask about it in due diligence. Make sure the contract covers:
- IP assignment: all code, designs and documents created for you are assigned to your US company, with a clear point at which ownership passes, such as on payment of each milestone.
- Where the code lives: the repository, cloud hosting, app store developer accounts and domain should be in your company's name, not the vendor's. This is how we work at Creuto from day one.
- Confidentiality: an NDA before you share detailed plans, and confidentiality terms in the main agreement.
- Governing law and disputes: which country's law applies and how disagreements are resolved. Your lawyer should review this part.
- Scope and change control: a written scope, how changes are priced and approved, and what happens if you pause or stop.
- Warranty and support: how long bugs are fixed after launch at no extra cost. Ours is 60 days.
The pricing model also shapes the contract. If you are unsure whether to fix the price or pay for time, read fixed price vs time and materials before you sign.
Paying a development partner in India
Paying an Indian company is straightforward once it is set up. A few points to sort out before the first invoice:
- Invoice currency: agree that invoices are in US dollars so your costs do not move with exchange rates.
- Payment method: international wire transfer is common, and some vendors also accept payment platforms. Ask which one the vendor's bank handles fastest.
- Tax paperwork: because the vendor is a foreign company, your accountant will usually ask for an IRS Form W-8BEN-E rather than a W-9. Ask for it at the start, and let your accountant confirm what applies to you.
- Milestone schedule: tie each payment to working software you have seen in a demo, not to time passing.

Book a free 30-minute call →US rules to plan for before design starts
The team in India builds the product, but the rules that apply come from your users and your market. Decide which ones apply early, because they change the design, the data model and the hosting choice.
- Health data: if your app handles protected health information, the HIPAA Security Rule sets out the safeguards: access control, audit logs, encryption and hosting with providers that sign a business associate agreement. Our guide to building a telemedicine app goes deeper.
- State privacy laws: California's CCPA and similar state laws give users rights to see and delete their data. Build consent, data export and deletion in from the first release.
- Children's apps: if your users may be under 13, the FTC's COPPA rule applies to how you collect and use their data.
- B2B buyers: enterprise customers often ask for SOC 2. Building role-based access, change history and monitored infrastructure from the start makes that audit easier later.
- Accessibility: designing to WCAG 2.1 AA keeps the product usable for everyone and easier to defend in accessibility reviews.
Your development partner should raise these questions in the first call. Legal sign-off still sits with your company and your advisers.
What the first month should look like
The first month tells you whether the partnership will work. Here is what I would expect to see, and what we aim for at Creuto:
- Week 1: a short discovery, then a written product requirements document with scope, priorities and what is left out on purpose.
- Week 1 to 2: screens designed and agreed, with the repository and cloud accounts set up in your company's name.
- Week 2 to 4: building in short cycles, with a demo on your morning call so you see real progress, not slide updates.
- Around week 4: a first working version you can click through and put in front of early users.
If you want to move fast on a first release, our MVP development service is built around this rhythm.
Planning the budget
Cost depends on scope, platforms and integrations far more than on location. To get a realistic picture before you talk to anyone, try our app cost calculator or look at sample project costs for products like marketplaces, delivery apps and ERP systems. Then ask any partner you are considering for a written, itemised proposal so you can compare like with like.
Red flags for US founders
- The vendor wants the code or app store accounts in its own name.
- No one senior joins calls in your time zone after the sale.
- A price is quoted before anyone has asked about your users, data or compliance needs.
- Progress is reported in hours and percentages, not working demos.
- No written warranty period after launch.

Frequently asked questions
What time zone overlap can a US company expect with a team in India?
India is 9.5 to 10.5 hours ahead of US Eastern Time, depending on US daylight saving, and India does not change its clocks. An Indian team's evening meets the East Coast morning. West Coast teams usually agree a fixed slot early in their morning or late in their evening.
Who owns the code when a US company hires a team in India?
Ownership is set by your contract, so it must say clearly that the intellectual property is assigned to your company. At Creuto the code lives in your own accounts from day one and ownership passes to you as each milestone is paid.
How does a US company pay a development partner in India?
Most US companies pay an Indian vendor against invoices in US dollars by international wire or through a payment platform. Your accountant will usually ask the vendor for a Form W-8BEN-E instead of a W-9, so ask for it at the start.
Can a team in India build a HIPAA or CCPA compliant product?
A team in India can build the technical safeguards these rules need, such as access control, audit logs, encryption and data deletion. Legal compliance and sign-off stay with your company and your advisers.
How quickly can we see working software?
At Creuto the first working version typically takes about 4 weeks, starting from a clear product requirements document. Larger products are then built in milestones with a demo at each one.
